ACCEPTABLE USE POLICY

1. Introduction and Scope
This Acceptable Use Policy (“Policy” or “AUP”) governs the use of the proxy services, network infrastructure, data collection services, and related infrastructure (collectively, the “Service”) provided by PROSOX LLC, a limited liability company organized under the laws of the State of Delaware, USA (“Prosox,” “we,” “us,” or “our”), through the website prosox.io (the “Site”) and any related dashboards, APIs, or applications.
This Policy is incorporated into, and forms an integral part of, our Terms of Service. It applies to every person or organization that accesses or uses the Service, including account holders, their end users, employees, contractors, and any party whose traffic passes through the Service (each, a “User,” “you,” or “your”).
By registering for, accessing, or using the Service, you agree to comply with this Policy. If you do not agree, you may not use the Service.
The Service is intended solely for persons who are at least 18 years of age. By using the Service, you represent that you are at least 18 years old and have the legal capacity and authority to accept this Policy and the Terms of Service on your own behalf or on behalf of the organization you represent.
Capitalized terms not defined herein have the meaning given to them in the Terms of Service.
We may update this Policy at any time in accordance with Section 13. Continued use of the Service after the amendments take effect constitutes acceptance of the updated Policy.
2. Definitions
Service — the proxy network, IP addresses, traffic (bandwidth), connection points, APIs, dashboards, and any related infrastructure or software provided by Prosox, including infrastructure provided through Prosox’s Upstream Providers (see Section 3.6).
Target Resource — any website, server, network, application, system, or resource that a User accesses, connects to, or directs traffic toward using the Service.
Content — any data, text, files, messages, requests, or materials that a User transmits, requests, collects, or processes through the Service.
Personal Data — any information relating to an identified or identifiable natural person within the meaning of applicable data protection law, including the EU/UK GDPR, the California Consumer Privacy Act (CCPA), as amended, the Law of the Republic of Uzbekistan “On Personal Data” (No. ZRU-547), as amended by Law No. ZRU-1125, and similar laws of other jurisdictions.
Abuse — any use of the Service that violates this Policy, applicable law, or the rights of third parties.
Upstream Provider — any third-party provider of infrastructure, IP addresses, bandwidth, or other resources that Prosox licenses, leases, or otherwise engages to provide the Service.
3. General User Obligations
You are solely responsible for all activity conducted through your account, and for all traffic and Content passing through the Service, regardless of whether such activity is carried out by you, your end users, or any person using your credentials.
You represent, warrant, and agree that:
3.1. You will use the Service solely for lawful purposes and in accordance with this Policy, the Terms of Service, and all laws, rules, and regulations applicable to you, your activities, and each Target Resource — including the laws of the United States, the State of Delaware, your own jurisdiction, and the jurisdiction of any Target Resource or affected person.
3.2. You have obtained and will maintain all rights, licenses, consents, and permissions necessary for the intended use, including any authorization required to access a Target Resource and any legal basis required to collect or process Personal Data.
3.3. You will not use the Service in any manner that could damage, disable, overburden, impair, or otherwise harm the Service, Prosox’s infrastructure, any Target Resource, or any third party.
3.4. You are responsible for maintaining the confidentiality of your credentials and for any use of the Service through your account. You must promptly notify us of any unauthorized use.
3.5. You will not resell, sublicense, or provide access to the Service to third parties, except as expressly authorized by Prosox in writing; where such use is authorized, you remain fully responsible for such third parties’ compliance with this Policy.
3.6. Compliance with Upstream Provider Requirements. Part of the infrastructure comprising the Service is licensed, leased, or otherwise procured by Prosox from Upstream Providers. In addition to this Policy, your use of the Service must comply with the applicable acceptable use policies and compliance requirements of such Upstream Providers, to the extent such policies and requirements are communicated to you or posted on the Site. A violation of an Upstream Provider’s policy constitutes a violation of this Policy. If an Upstream Provider requires Prosox to suspend, restrict, or terminate access for a particular User, traffic, or Content, Prosox may comply with such requirement immediately and without prior notice in accordance with Section 8.3, regardless of whether the activity in question independently constitutes a violation of any other provision of this Policy.
4. Prohibited Activities
You may not use the Service, and may not permit or enable any other person to use the Service, for any of the following. The categories below are illustrative, not exhaustive; any activity that is unlawful, harmful, or constitutes Abuse is prohibited regardless of whether it is expressly listed.
4.1. Unlawful Activity
- Any activity that violates applicable local, regional, national, or international law.
- Any activity that assists, encourages, or enables another person to commit unlawful acts.
- Any activity that infringes, misappropriates, or otherwise violates the rights of any third party.
4.2. Network Attacks and Security Breaches
- Obtaining or attempting to obtain unauthorized access to any system, network, account, data, or Target Resource (including any conduct that violates the U.S. Computer Fraud and Abuse Act (CFAA) or similar laws).
- Denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks, flooding, or any activity intended to disrupt or overburden a Target Resource or network.
- Unauthorized port scanning, vulnerability scanning, penetration testing, or probing of systems that you do not own or do not have written authorization to test.
- Developing, distributing, hosting, or transmitting malware, ransomware, viruses, worms, trojans, spyware, or other malicious code.
- Credential stuffing, password brute-forcing, account or session hijacking, or intercepting communications not intended for you (e.g., man-in-the-middle attacks).
- Circumventing, disabling, or defeating security measures, authentication mechanisms, or access controls without lawful authorization.
4.3. Fraud and Deception
- Payment fraud, carding, money laundering, or any financial crime.
- Identity theft, impersonation of another person or organization, or misrepresenting your affiliation with any person or organization.
- Phishing, pharming, social engineering, or the creation of fraudulent or deceptive websites, forms, or messages.
- Advertising fraud, click fraud, impression fraud, affiliate fraud, or manipulation of advertising or analytics systems.
- Creating fake or fraudulent accounts, or evading blocks or restrictions for fraudulent or unlawful purposes.
4.4. Spam and Unsolicited Messages
- Sending unsolicited bulk email, messages, or mailings in violation of the CAN-SPAM Act, the ePrivacy Regulation, or similar anti-spam legislation.
- Comment spam, forum spam, fake reviews, or automated posting in violation of platform rules or applicable law.
- Any activity that results in Prosox’s IP addresses being added to spam or abuse blocklists.
4.5. Unlawful Data Collection and Privacy Violations
- Collecting, scraping, extracting, or processing Personal Data without a valid legal basis and in violation of applicable data protection law (including the GDPR, UK GDPR, CCPA/CPRA, the data protection laws of the Republic of Uzbekistan, and similar laws).
- Accessing or collecting data by circumventing an authorization system, paywall, or other authentication barrier without proper authorization.
- Bypassing technical access controls in a manner prohibited by applicable law.
- Collecting or using data to facilitate stalking, doxxing, harassment, discrimination, or harm to individuals.
- Collecting special categories of Personal Data (e.g., health data, biometric data, or children’s data) in violation of law.
- Scraping or accessing a Target Resource in violation of its terms of use where such violation is unlawful, or continuing to access a Target Resource after access has been expressly revoked.
4.6. Intellectual Property Infringement
- Infringing any copyright, trademark, patent, trade secret, or other intellectual property or proprietary right.
- Distributing, uploading, or providing access to pirated, counterfeit, or infringing materials.
- Circumventing digital rights management (DRM) or other protective measures in violation of law.
4.7. Prohibited and Harmful Content
You may not use the Service to access, transmit, store, distribute, request, or facilitate:
- Child sexual abuse material (CSAM) or any content that sexualizes, exploits, or endangers minors. Zero tolerance applies — see Section 5.
- Non-consensual intimate imagery or content that violates a person’s sexual privacy.
- Content that promotes, facilitates, or incites terrorism, violent extremism, or mass violence.
- Human trafficking, forced labor, or the sexual exploitation of any person.
- The unlawful sale or distribution of controlled substances, prohibited drugs, weapons, or other regulated goods.
- Threats of violence, harassment, stalking, or content that incites imminent unlawful harm.
- Content that unlawfully incites hatred, discrimination, or violence against persons or groups.
4.8. Sanctions, Export Controls, and Restricted Persons
- You may not use the Service if you are (or are acting on behalf of) a person or entity subject to economic sanctions, including any party listed on the U.S. Department of the Treasury Office of Foreign Assets Control (OFAC) Specially Designated Nationals (SDN) List, the European Union Consolidated Financial Sanctions List, or the UK Office of Financial Sanctions Implementation (OFSI) sanctions list, or if the provision or use of the Service in the relevant jurisdiction is prohibited by sanctions restrictions applicable to Prosox.
- You must comply with all applicable export control and sanctions laws, including those of the United States, the European Union, and the United Kingdom, and may not use the Service to violate them.
4.9. Service Abuse and Interference
- Reverse engineering, decompiling, or attempting to derive the source code or internal structure of the Service, except as permitted by law.
- Using the Service to attack, probe, or interfere with Prosox’s own infrastructure, other Users, or the proxy network.
- Exceeding, circumventing, or manipulating usage limits, rate limits, or technical restrictions.
- Any use that degrades the quality or availability of the Service for other Users.
5. Child Safety — Zero Tolerance
Prosox maintains a strict zero-tolerance policy toward any content or conduct that sexually exploits or endangers minors, including child sexual abuse material (CSAM).
Any account associated with such content or conduct will be immediately terminated without notice and without refund. To the extent required by applicable law, we will preserve relevant information and report such activity to the U.S. National Center for Missing & Exploited Children (NCMEC) and/or the relevant law enforcement authorities. This Section applies notwithstanding any other provision of this Policy or the Terms of Service.
6. Special Requirements for Proxy Use and Data Collection
Because the Service is used to route traffic to third-party Target Resources, the following requirements apply in addition to Section 4:
6.1. Respect for Target Resources. You may not send requests at a volume or frequency that overburdens, disrupts, or impairs the functioning of a Target Resource’s servers or network. You must apply reasonable rate limiting and technically responsible collection practices.
6.2. Compliance with Target Resource Rules and Law. You are solely responsible for determining whether your access to, and collection from, any Target Resource is lawful and authorized, including compliance with the Target Resource’s terms, robots directives (where legally relevant), and all applicable law. Prosox does not review, approve, or endorse any User’s Target Resources or use cases.
6.3. Public Data Collected Lawfully Only. The Service must not be used to access non-public data without authorization, or to collect Personal Data without a legal basis and without compliance with data protection law.
6.4. Data Minimization. When collecting Personal Data, you must limit collection to what is necessary and lawful, and handle such data in accordance with applicable law and your own privacy obligations to data subjects.
6.5. Prohibition on Unlawful Circumvention. You may not use the Service to circumvent lawful geographic, technical, or contractual restrictions in a manner that violates applicable law or a binding agreement.
You acknowledge that, with respect to Personal Data that you collect or process using the Service in relation to Target Resources, you — and not Prosox — are the controller of such data, and you bear sole responsibility for its processing in accordance with applicable law. This provision does not affect Prosox’s role as an independent controller with respect to your account data, payment information, and traffic-related service metadata, which Prosox processes for the purpose of providing and administering the Service, as described in our Privacy Policy.
7. Risk-Based Verification
Prosox applies a risk-based approach for the purpose of preventing fraud, Abuse of the Service, violations of applicable sanctions restrictions, and other unlawful conduct or conduct prohibited by this Policy.
Information obtained through such verification is processed in accordance with applicable law and Prosox’s Privacy Policy.
If a User fails to provide reasonably requested information, or if, based on the results of its assessment, Prosox reasonably determines that an unacceptable legal, sanctions, fraud, technical, or other risk exists, Prosox may restrict, suspend, or terminate provision of the Service in accordance with this Policy and the Terms of Service.
During the course of a verification review, Prosox may restrict or suspend provision of the Service, in whole or in part, where reasonably necessary to prevent potential Abuse, protect the Service, or comply with applicable requirements.
The scope of such verification is determined based on the nature and level of the risk identified.
Prosox does not conduct mandatory verification of every User. However, where heightened risk factors, indicators of Abuse, or unusual or suspicious use of the Service are identified, or where necessary to comply with applicable law or the requirements of Upstream Providers, Prosox may request additional information from the User that is reasonably necessary to assess the relevant risk and the nature of the User’s use of the Service.
8. Monitoring, Investigation, and Enforcement
8.1. No Obligation to Monitor. We are under no obligation to monitor use of the Service. Nevertheless, we reserve the right to monitor, investigate, and review use of the Service to the extent necessary to operate the Service, enforce this Policy, protect our infrastructure and other Users, and comply with law. Any monitoring is conducted in accordance with our Privacy Policy.
8.2. Consequences of Violation. If we determine, in our reasonable discretion, that you have violated this Policy, we may take any action we deem appropriate, including:
- issuing a warning;
- rate-limiting, restricting, suspending, or terminating your access to the Service, in whole or in part;
- removing or blocking access to violating Content or traffic;
- suspending or terminating your account without refund; and
- reporting the activity to law enforcement or other authorities.
8.3. Immediate Action. In the case of serious violations — including CSAM, network attacks, fraud, sanctions violations, or any conduct creating a risk of harm or legal liability — we may suspend or terminate access immediately and without prior notice.
8.4. No Refunds for Violations. Suspension or termination for violation of this Policy does not entitle you to a refund and does not limit any other remedy available to us, except where applicable mandatory consumer protection law expressly provides otherwise.
8.5. Cooperation. You agree to cooperate with any reasonable investigation of suspected Abuse that we conduct.
8.6. Abuse Incident Records. Prosox may maintain internal records of abuse reports, identified incidents, and actions taken, to the extent reasonably necessary to review such matters, prevent repeat violations, protect the Service, and comply with applicable requirements.
Such records may include information about the incident, its source and nature, available supporting data, the actions taken, and the outcome of the review.
Such information is retained only for as long as necessary for the stated purposes or as required by applicable law, and is processed in accordance with Prosox’s Privacy Policy. Access to such information is limited to authorized personnel. Where a lawful basis exists, the relevant information may be disclosed to Upstream Providers or competent authorities.
Failure to enforce any provision of this Policy does not constitute a waiver of our right to enforce it thereafter.
9. Abuse Reports
If you become aware of any use of the Service that may violate this Policy, please report it to:

Where possible, please include the IP address or connection point, the date and time of the incident, a brief description, and any available supporting data. Prosox reviews such reports and, where appropriate, takes action in accordance with this Policy.
Information regarding a report and the outcome of its review may be recorded as part of the internal incident records described in Section 8.6.
10. Intellectual Property Infringement Notices
10.1. If you believe that Content or activity accessible through the Service infringes your copyright, trademark, or other intellectual property right, you may submit a notice to abuse@prosox.io that includes: (a) a description of the protected work that has allegedly been infringed; (b) a description, and where possible the location, of the allegedly infringing material or activity within the Service; (c) your contact information; (d) a statement of your good-faith belief that the use is not authorized by the rights holder, its agent, or the law; (e) a statement, made under penalty of perjury, that the notice is accurate and that you are authorized to act on behalf of the rights holder; and (f) your physical or electronic signature.
10.2. Prosox provides network proxy infrastructure and, as a general matter, does not host or store third-party Content on its servers in the capacity of a hosting provider. To the extent a notice relates to Content actually hosted or controlled by Prosox, we will review the notice and, where there is a sufficient basis, remove or disable access to the relevant material in a manner analogous to that provided under 17 U.S.C. § 512. In other cases, we may forward the notice to the operator of the relevant Target Resource or other responsible party.
10.3. We may disclose the contents of a notice and your contact information to the affected User, and may take any action described in Section 8 with respect to confirmed violations.
11. Suspension, Termination, and Survival
We may suspend or terminate your access to the Service as described in this Policy and the Terms of Service. Upon termination, your right to use the Service ends immediately. Provisions that by their nature should survive termination — including those relating to liability for past use, prohibited conduct, indemnification, and limitation of liability — shall survive.
12. Indemnification, Limitation of Liability, and Dispute Resolution
You agree to defend, indemnify, and hold harmless Prosox and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or relating to your use of the Service, your Content, your Target Resources, or your violation of this Policy, the Terms of Service, or any law or third-party right.
Prosox disclaims, and shall have no liability for, any acts or omissions of Users, including any User’s access to or collection from any Target Resource. Additional limitations of liability are set out in the Terms of Service, which are incorporated herein by reference.
Any dispute, claim, or controversy arising out of or relating to this Policy shall be resolved in accordance with the arbitration provisions, governing law, and class action waiver set forth in the Terms of Service; such provisions apply in full to this Policy and are incorporated herein by reference.
13. Amendments to this Policy
We may revise this Policy from time to time to reflect changes in our Service, legal requirements, or industry practice. The updated version will be posted on this page with a new “Last Updated” date and will take effect as of that date (or as otherwise indicated). We recommend that you review this Policy periodically. Continued use of the Service after the effective date of an amendment constitutes acceptance of the updated Policy.
14. Severability
If any provision of this Policy is held to be invalid or unenforceable, that provision shall be limited or excluded to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
