LIMITED LIABILITY COMPANY PROSOX

1. Introduction and Scope

This Acceptable Use Policy (the “AUP” or “Policy”) governs the use of the proxy, network, data-collection, and related infrastructure services (collectively, the “Service”) made available by LIMITED LIABILITY COMPANY PROSOX (”Prosox,” “we,” “us,” or “our”) through the website prosox.io (the “Site”) and any associated dashboards, APIs, or applications.

This Policy is incorporated into and forms part of our Terms of Service. It applies to every person or entity that accesses or uses the Service, including account holders, their end users, employees, contractors, and any party whose traffic is routed through the Service (each, a “User,” “you,” or “your”).

By registering for, accessing, or using the Service, you agree to comply with this Policy. If you do not agree, you must not use the Service. Capitalized terms not defined here have the meaning given in the Terms of Service.

We may update this Policy at any time in accordance with Section 13. Your continued use of the Service after changes take effect constitutes acceptance of the revised Policy.

2. Definitions

  • Service — the proxy network, IP addresses, bandwidth, endpoints, APIs, dashboards, and any related infrastructure or software provided by Prosox.
  • Target — any website, server, network, application, system, or resource that a User accesses, connects to, or routes traffic toward using the Service.
  • Content — any data, text, files, communications, requests, or material that a User transmits, requests, collects, or processes through the Service.
  • Personal Data — any information relating to an identified or identifiable natural person, as defined under applicable data-protection laws (including the EU/UK GDPR, the California Consumer Privacy Act as amended, and comparable laws).
  • Abuse — any use of the Service that violates this Policy, applicable law, or the rights of any third party.

3. General User Responsibilities

You are solely responsible for all activity conducted through your account and for all traffic and Content routed through the Service, whether by you, your end users, or anyone using your credentials.

You represent, warrant, and agree that:

  • 3.1. You will use the Service only for lawful purposes and in compliance with this Policy, the Terms of Service, and all laws, regulations, and rules applicable to you, to your activity, and to each Target — including the laws of the United States, the State of Delaware, your own jurisdiction, and the jurisdiction of any Target or affected party.
  • 3.2. You have obtained, and will maintain, all rights, licenses, consents, and authorizations necessary for your intended use, including any authorization required to access a Target and any lawful basis required to collect or process Personal Data.
  • 3.3. You will not use the Service in any manner that could damage, disable, overburden, impair, or otherwise harm the Service, Prosox’s infrastructure, any Target, or any third party.
  • 3.4. You are responsible for maintaining the confidentiality of your account credentials and for any use of the Service through your account. You must notify us immediately of any unauthorized use.
  • 3.5. You will not resell, sublicense, or provide access to the Service to third parties except as expressly permitted in writing by Prosox, and where permitted, you remain fully responsible for such third parties’ compliance with this Policy.

4. Prohibited Activities

You must not use the Service, and must not permit or enable any other person to use the Service, for any of the following. The categories below are illustrative, not exhaustive; any activity that is unlawful, harmful, or abusive is prohibited whether or not specifically listed.

4.1. Unlawful Activity

  • Any activity that violates applicable local, state, national, or international law or regulation.
  • Any activity that facilitates, promotes, or enables illegal acts by another person.
  • Any activity that infringes, misappropriates, or violates the rights of any third party.

4.2. Network Attacks and Security Abuse

  • Gaining or attempting to gain unauthorized access to any system, network, account, data, or Target (including any conduct violating the U.S. Computer Fraud and Abuse Act or equivalent laws).
  • Denial-of-service (DoS) or distributed denial-of-service (DDoS) attacks, flooding, or any activity designed to disrupt or overload a Target or network.
  • Unauthorized port scanning, vulnerability scanning, penetration testing, or probing of systems you do not own or lack written authorization to test.
  • Developing, distributing, hosting, or transmitting malware, ransomware, viruses, worms, trojans, spyware, or other malicious code.
  • Credential stuffing, password brute-forcing, account takeover, session hijacking, or interception of communications not intended for you (e.g., “man-in-the-middle” attacks).
  • Circumventing, disabling, or defeating security measures, authentication mechanisms, or access controls without lawful authorization.

4.3. Fraud and Deception

  • Payment fraud, “carding,” money laundering, or any financial crime.
  • Identity theft, or impersonating any person or entity or misrepresenting your affiliation with any person or entity.
  • Phishing, pharming, social engineering, or the creation of fraudulent or deceptive websites, forms, or communications.
  • Advertising fraud, click fraud, impression fraud, affiliate fraud, or manipulation of analytics or ad systems.
  • Creating fake or fraudulent accounts, or engaging in ban evasion or restriction circumvention for fraudulent or unlawful purposes.

4.4. Spam and Unsolicited Communications

  • Sending unsolicited bulk email, messages, or communications in violation of the CAN-SPAM Act, the ePrivacy rules, or comparable anti-spam laws.
  • Comment spam, forum spam, review manipulation, or automated posting in violation of a platform’s rules or applicable law.
  • Any activity that results in Prosox IP addresses being listed on spam or abuse blocklists.

4.5. Unlawful Data Collection and Privacy Violations

  • Collecting, scraping, harvesting, or processing Personal Data without a valid lawful basis and in violation of applicable data-protection laws (including the GDPR, UK GDPR, CCPA/CPRA, and comparable laws).
  • Accessing or collecting data located behind a login, paywall, or other authentication barrier without proper authorization.
  • Circumventing technical access controls in a manner prohibited by applicable law.
  • Collecting or using data to enable stalking, doxxing, harassment, discrimination, or any harm to individuals.
  • Collecting special categories of Personal Data (such as health, biometric, or children’s data) in violation of law.
  • Scraping or accessing a Target in violation of that Target’s Terms of Service where such violation is unlawful, or continuing to access a Target after access has been expressly revoked.

4.6. Intellectual Property Infringement

  • Infringing any copyright, trademark, patent, trade secret, or other intellectual property or proprietary right.
  • Distributing, downloading, or enabling access to pirated, counterfeit, or infringing material.
  • Circumventing digital rights management (DRM) or other technical protection measures in violation of law.

4.7. Prohibited and Harmful Content

You must not use the Service to access, transmit, store, distribute, request, or facilitate:

  • Child sexual abuse material (CSAM) or any content that sexualizes, exploits, or endangers minors. This is subject to zero tolerance — see Section 5.
  • Non-consensual intimate imagery or content that violates a person’s sexual privacy.
  • Content that promotes, facilitates, or incites terrorism, violent extremism, or mass violence.
  • Human trafficking, forced labor, or the sexual exploitation of any person.
  • The unlawful sale or distribution of controlled substances, illegal drugs, weapons, or other regulated goods.
  • Threats of violence, harassment, stalking, or content that incites imminent unlawful harm.
  • Content unlawfully promoting hatred, discrimination, or violence against individuals or groups.

4.8. Sanctions, Export Controls, and Restricted Parties

  • You must not use the Service if you are, or are acting on behalf of, any person or entity that is the subject of economic sanctions (including any party on the U.S. Treasury OFAC Specially Designated Nationals list) or located in any comprehensively embargoed or restricted jurisdiction.
  • You must comply with all applicable export-control and sanctions laws and must not use the Service to violate them.

4.9. Abuse of the Service and Interference

  • Reverse-engineering, decompiling, or attempting to derive the source code or underlying structure of the Service, except to the extent permitted by law.
  • Using the Service to attack, probe, or interfere with Prosox’s own infrastructure, other Users, or the proxy network.
  • Exceeding, evading, or manipulating usage limits, rate limits, or technical restrictions.
  • Any use that degrades Service quality or availability for other Users.

5. Child Safety — Zero Tolerance

Prosox maintains a strict zero-tolerance policy toward any content or conduct that sexually exploits or endangers minors, including child sexual abuse material (CSAM).

Any account associated with such content or conduct will be immediately terminated without notice or refund. To the extent required by applicable law, we will preserve relevant information and report such activity to the National Center for Missing & Exploited Children (NCMEC) and/or the appropriate law-enforcement authorities. We will cooperate fully with any resulting investigation. This Section applies regardless of any other provision of this Policy or the Terms of Service.

6. Proxy- and Data-Collection-Specific Requirements

Because the Service is used to route traffic to third-party Targets, the following requirements apply in addition to Section 4:

  • 6.1. Respect for Targets. You must not send requests at a volume or frequency that overloads, disrupts, or degrades a Target’s servers or network. You must use reasonable rate-limiting and adopt technically responsible collection practices.
  • 6.2. Compliance with Target rules and law. You are solely responsible for determining whether your access to, and collection from, any Target is lawful and permitted, including compliance with the Target’s terms, robots directives where legally relevant, and all applicable laws. Prosox does not review, approve, or endorse any User’s Targets or use cases.
  • 6.3. Public data only, lawfully collected. The Service must not be used to access non- public data without authorization, or to collect Personal Data without a lawful basis and compliance with data-protection law.
  • 6.4. Data minimization. Where you collect Personal Data, you must limit collection to what is necessary and lawful and must handle it in accordance with applicable law and your own privacy obligations to data subjects.
  • 6.5. No unlawful circumvention. You must not use the Service to circumvent lawful geographic, technical, or contractual restrictions in a manner that violates applicable law or a binding agreement.

You acknowledge that you, and not Prosox, act as the controller of, and are responsible for, any Personal Data you collect or process using the Service.

7. Verification and Know-Your-Customer

We may, at our discretion and to the extent permitted or required by law, request information to verify your identity, business, or intended use of the Service, including for anti-fraud, anti-money-laundering, or sanctions-screening purposes. We may suspend or decline to provide the Service pending satisfactory verification, and we may refuse service to any person or entity at our discretion.

8. Monitoring, Investigation, and Enforcement

  • 8.1. No obligation to monitor. We are not obligated to monitor use of the Service. However, we reserve the right to monitor, investigate, and review use of the Service to the extent necessary to operate the Service, ensure compliance with this Policy, protect our infrastructure and other Users, and comply with law. Any monitoring is conducted consistent with our Privacy Policy.
  • 8.2. Consequences of violation. If we determine, in our reasonable discretion, that you have violated this Policy, we may take any action we consider appropriate, including:
    • issuing a warning;
    • throttling, restricting, suspending, or terminating your access to the Service, in whole or in part;
    • removing or disabling access to offending Content or traffic;
    • suspending or terminating your account without refund; and
    • reporting the activity to law enforcement or other authorities.
  • 8.3. Immediate action. For severe violations — including CSAM, network attacks, fraud, sanctions violations, or any conduct posing a risk of harm or legal liability — we may suspend or terminate access immediately and without prior notice.
  • 8.4. No refunds for violations. Suspension or termination for a violation of this Policy does not entitle you to any refund, and does not limit any other remedy available to us.
  • 8.5. Cooperation. You agree to cooperate with any reasonable investigation we undertake into suspected Abuse.

The failure to enforce any provision of this Policy is not a waiver of our right to do so later.

9. Reporting Abuse

If you become aware of any use of the Service that may violate this Policy, please report it to our abuse team:

To help us investigate, please include, where possible: the offending IP address or endpoint, the date and time (with time zone), a description of the activity, and any supporting evidence (such as logs or headers). We review reports and take appropriate action in a timely manner. We may follow up with you for additional information.

10. Cooperation with Law Enforcement and Legal Process

We may access, preserve, and disclose information about Users and their use of the Service where we believe in good faith that doing so is necessary to: comply with applicable law, regulation, legal process, or a governmental request; enforce this Policy or the Terms of Service; detect, prevent, or address fraud, security, or technical issues; or protect against imminent harm to the rights, property, or safety of Prosox, our Users, or the public. Where legally permitted, we handle such matters in accordance with our Privacy Policy.

11. Suspension, Termination, and Survival

We may suspend or terminate your access to the Service as described in this Policy and the Terms of Service. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination — including those relating to responsibility for past use, prohibited conduct, indemnification, and liability — will survive.

12. Indemnification and Limitation of Liability

You agree to defend, indemnify, and hold harmless Prosox and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your Content, your Targets, or your violation of this Policy, the Terms of Service, or any law or third-party right.

Prosox is not responsible for, and disclaims all liability arising from, the acts or omissions of Users, including any User’s access to or collection from any Target. Additional limitations of liability are set out in the Terms of Service, which are incorporated by reference.

13. Changes to This Policy

We may revise this Policy from time to time to reflect changes in our Service, legal requirements, or industry practice. The updated version will be posted on this page with a revised “Last Updated” date and will take effect as of that date (or as otherwise stated). We encourage you to review this Policy periodically. Your continued use of the Service after the effective date constitutes acceptance of the revised Policy.

14. Severability

If any provision of this Policy is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
